The Supreme Court has ordered that the disabled candidates get 3 per cent reservation in all posts and services under the Government of India.
Prior to this reservation in government offices was restricted to Group C and Group D posts for disabled candidates. The Department of Personnel and Training also distinct them in the Memoranda of 1997 and 2005: there was no reservation for filling the posts of Group A and B through promotion.
Supreme Court bench under Justices Chelameswar and Abhay M Sapre ruled the memorandum of DOPT as illegal and inconsistent with the persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act 1995.
Many High Courts had passed judgement in for disabled candidates earlier also, but the central government always appealed against these orders to nullify them. But after this judgement by the Supreme Court, they will have to abide by the ruling and permit 3 per cent reservation to the disabled candidate.
